DESIGN APPLICATION IN INDIA

In India a foreign applicant can file an application for a design registration for their industrial designs either as an ordinary application without claiming any priority or as a reciprocity application claiming priority from an application filed previously in a convention country. The deadline to file a reciprocity application is six months from the date of filing in convention country without any extension.

The classification of articles is based on the International Classification of Industrial Designs according to the Locarno Agreement. It is to be noted that a multi-class design application is not allowed in India.

DOCUMENTS REQUIRED

– Applicant’s particulars (Name, address and nationality)

– Name, Class & Sub Class of the article to which the design is applied as under the Locarno Classification.

– Power of Attorney in our favor

– Representations illustrating each view of the article wherein the novelty lies preferably in the form of photographs or  exact drawing figures showing the perspective, front, rear, top, bottom and side views of the article.

– Certified copy of the Priority documents in case of reciprocity application along with its verified English translation (if the priority document is in non-English language)

* DAS code may be submitted in lieu of certified copy of priority document
